Terms and Conditions (T&C) – EthioBid

§ 1 Scope & Subject Matter
These T&C apply to the use of the online auction platform EthioBid (hereinafter “Service”), operated by Majesty Developers, owner Omar Jelalu Awel, Irenenstraße 66, 40468 Düsseldorf. EthioBid allows users to participate in online auctions as buyers or sellers or to trade items at fixed prices.
§ 2 Registration and Contract Conclusion
The use of the Service requires registration. By completing the registration, a free user agreement is concluded. Listing items or placing bids may be subject to fees (e.g., by purchasing 'Bids').
§ 3 Contract Conclusion in Auctions and Purchases
a) In auctions, a legally binding purchase contract is concluded between the seller and the highest bidder at the end of the auction. EthioBid acts solely as an intermediary.
b) For fixed-price items ('Buy It Now'), a purchase contract is concluded when the buyer accepts the offer.
§ 4 Fees and Payment
Registration is free. Fees in the form of 'Bids' or listing fees may apply for bidding or listing auctions. These must be purchased in advance. Payments are processed through the offered payment service providers (e.g., Stripe). Invoices are provided electronically.
§ 5 User Obligations
Users are obligated to provide truthful information during registration. Sellers must describe items accurately. Buyers are obligated to accept and pay for the items they have won or purchased. Abusive use, especially shill bidding (bidding on one's own items), is prohibited.
§ 6 Availability
We strive to ensure high availability of the Service but cannot guarantee uninterrupted access. Announced maintenance work is not considered downtime.
§ 7 Termination & Revocation
The user agreement can be terminated by either party at any time. Details on the right of revocation for the purchase of services (e.g., 'Bids') can be found in the separate revocation policy. The statutory provisions apply to purchase contracts between users; a right of revocation may be excluded in auctions under certain circumstances.
§ 8 Liability
As the platform operator, EthioBid is liable only for intent and gross negligence. Users are responsible for the items they offer and for the execution of the purchase contracts. EthioBid assumes no liability for the quality or legality of the traded items.
§ 9 Final Provisions
German law applies. If the user is a merchant, the place of jurisdiction is Düsseldorf.
